General conditions of use

Last update:

1. Preamble and Acceptance

Welcome to Airsoft Companion! By accessing our website and using our services, you agree to be bound by these Terms of Use (hereinafter "TOU"). They govern your access to and use of the platform. If you do not accept these conditions, you must not use our services.

2. Service description

Airsoft Companion is a community platform designed for airsoft enthusiasts. Our services include, but are not limited to:

  • Create and manage detailed user profiles (equipment, statistics, reputation).
  • Search and register for airsoft games organized by the community.
  • Event (party) creation and management for organizers.
  • Creating, managing and joining teams.
  • A private messaging system for communicating with other users and teams.
  • An interactive map listing stores and events.
  • A rating and reputation system between users.
  • Practical tools for players (calculators, glossary, etc.).

3. Age and Registration Conditions

Minimum age for the platform: The use of Airsoft Companion is reserved for the elderly of at least 14 years. By registering, you certify that you have reached this minimum age.

Participation in the parties: If you have not reached the age of majority in your country of residence, you must be accompanied by a legal representative (parent or guardian) to participate in any part of the airsoft. It is the responsibility of the organizers to verify the age of the participants and to ensure compliance with this accompanying obligation for minor players.

Since the practice of airsoft is regulated, registration with certain parties may be subject to additional restrictions defined by the organizers or local legislation. It is your responsibility to verify and comply with the regulations applicable in your jurisdiction.

Access to most features requires the creation of an account. By registering, you agree to :

  • Provide accurate, complete and up-to-date information, including your date of birth.
  • Maintain the confidentiality of your password and account. You are solely responsible for all activities that occur under your account.
  • We offer an optional identity verification procedure to enhance trust within the community. The specific conditions for this verification are detailed in our Privacy Policy.

4. Account management

4.1 Modification of information

You can change your personal information at any time from your account settings.

4.2 Account deletion

You can request the deletion of your account at any time from your profile settings or by contacting us via our contact page. The deletion results in:

  • Permanent deletion of your profile and personal data.
  • Anonymization of your messages and comments (content can be retained but will no longer be associated with your identity).
  • Loss of your history of parts, reputation and badges.
  • If you are a team leader, you must transfer the property or dissolve the team before deleting your account.

The removal is irreversible and will be effective within 30 days. Some data may be retained if we are legally required to do so.

5. Content User

You are responsible for any content (texts, images, profile information, messages) that you publish on Airsoft Companion ("User Content"). By publishing this content, you grant us a global, non-exclusive, free and transferable license to use, reproduce, modify, adapt, publish and display this content as part of the provision of our services.

You retain all property rights in the content you publish and can revoke this license by deleting your content from the site.

You guarantee that your User Content does not violate any third party rights (copyright, trademark, privacy, etc.) and is not illegal, misleading or malicious.

6. Conduct and Moderation Rules

To ensure a positive and safe experience, all users must respect the following rules:

  • Respect and courtesy: Harassment, insults, discrimination and any form of hate speech are strictly forbidden.
  • Inappropriate content: Do not publish any illegal, violent, pornographic, defamatory or offensive content.
  • Honesty: Don't pretend to be someone else, create fake profiles or publish misleading information (e.g. about events).
  • Security: Don't share sensitive personal information and respect the privacy of other users.

We have set up a reporting system to help us maintain a healthy community. Any user can report content or behavior that violates these rules. Our moderation team will review reports and may take appropriate action, including :

  • Issuing a warning.
  • Removal of contentious content.
  • Temporary suspension or permanent termination of your account.

6.1 Reputation-based automatic suspension

Airsoft Companion has a rating system that allows users to evaluate their interactions with other members of the community. In order to maintain a quality environment, a user account can be automatically suspended if:

  • The user received a minimum of 25 ratings from other users.
  • The average of these ratings is less than 2 stars out of 5.

This automatic suspension is intended to protect the community from recurring behaviours that are deemed inappropriate by a significant number of members. The user concerned will be notified of this suspension and can challenge this decision by contacting our team via contact page. Our moderation team will then examine the situation and will be able to lift the suspension if it considers that it is not justified.

7. Roles and Responsibilities

Game organizers

Organizers are responsible for the proper conduct of the events they publish: accuracy of information, compliance with local safety regulations, necessary insurance, etc. Airsoft Companion is only a matchmaking platform and cannot be held responsible for the way in which games are run.

When an organizer changes substantially a portion of the registrants (date, schedule, place or rules), the registrants may unsubscribe and obtain a full refund, in accordance with section 4.4 of our General Conditions of Sale.

Strip account connection (optional): Connecting the Stripe account to our platform is not mandatory. However, it is essential for party registration payments to pass through the Airsoft Companion platform. Without this link, it is impossible to pass payments through the platform, and the organiser as well as participants cannot benefit from the coverage and benefits provided by our Terms and Conditions of Sale (security of transactions, management of refunds in case of cancellation, traceability of payments, etc.). In such cases, transactions will have to take place outside the platform, without the intermediation or guarantees of Airsoft Companion.

When an organizer chooses to link his or her Stripe account, this link ensures the security of financial transactions between the organizers and the participants, as well as the smooth flow of refunds in case of cancellation in accordance with our Terms and Conditions of Sale.

Prohibition of participants' use of data for commercial purposes: Organisers are strictly prohibited from using, collecting, storing or transmitting the participants' personal information (name, first name, e-mail address, telephone number, or any other data accessible via the platform) for commercial, advertising, prospecting or marketing purposes, whether on their own behalf or on behalf of third parties. Any violation of this prohibition constitutes a serious breach of these Terms and Conditions and may result in:

  • The immediate and definitive cancellation the Airsoft Companion platform organiser's account.
  • The suppression of all its published events.
  • judicial proceedings for violation of these CGUs and the applicable regulations for the protection of personal data (including GDPR).
  • Where appropriate, a claim for damages for the damage caused to the users concerned and the platform.

Team leaders

Team leaders are responsible for managing their team members, including recruitment and exclusion, and for their team's image on the platform.

9. Limitation of Liability

Airsoft is a risky business. Airsoft Companion acts as an intermediary and can under no circumstances be held responsible for incidents (injuries, theft, disputes) occurring before, during or after games, or during exchanges between users. Each participant undertakes to be covered by civil liability insurance and to comply with safety instructions.

Payments and registrations outside the platform: When an organiser has not linked his Stripe account to the platform, or when payments and registrations are made outside the Airsoft Companion platform (including bank transfer, cash, or any other external payment method), Airsoft Companion cannot be held responsible for any problems encountered. This includes, but is not limited to:

  • Payment or non-payment disputes
  • Difficulties or impossibility of repayment in case of cancellation
  • Fraud, fraud or embezzlement
  • Errors in entering, doubling or losing data related to an off-platform managed registration
  • Defects of confirmation, traceability or proof of payment

In such cases, transactions and registrations are the sole responsibility of the organizer and the participant. Airsoft Companion has no means of intervention, mediation or guarantee on these external operations. To benefit from the security and guarantees of the platform, it is recommended to use the integrated payment system via Stripe.

10. Major Force

Airsoft Companion may not be held responsible for the total or partial non-performance of its obligations if such non-performance is caused by an event constituting force majeure, in particular in the event of a total or partial disruption or strike of postal services and means of transport and/or communications, flood, fire, pandemic, government measures, etc.

11. Dividend

If any of the provisions of these Rules were declared null or void by a competent court, such nullity would not affect the other provisions that remain in force and will retain their full effect.
